Purpose/Standard for Coverage
Same as the Americans with Disabilities Act, except:
- Applies to employees of the federal government (almost exclusively to those in the Executive Branch).
- Procedure is different.
Procedure
- Must contact an equal employment opportunity counselor at the agency where the discrimination occurred within 45 days of the discrimination.
- Agency investigates.
- Employee can then ask for a hearing conducted by an administrative law judge from the EEOC or for a final decision by the agency.
- Employee can appeal to the EEOC and then go to court or can go directly to court.
